Hadith on Marriage: Rights are at the intersection of duties in marriage

‘Uqbah ibn ‘Amr reported: The Messenger of Allah, peace and blessings be upon him, said, “The most worthy of conditions to fulfill (in marriage) are those that permit intimacy.”

And Umar ibn al-Khattab said, “Verily, rights are at the intersection of conditions. You will have what you accepted as conditions.”

Al-Nawawi said, “Al-Shafi’i and most of the scholars said this is interpreted to mean conditions that do not nullify the requirements of the marriage contract. Rather, they are among its requirements and purposes, such as stipulating the condition of living with them in a good manner, spending on them, clothing them, and providing residence for them in a good manner, and that he does not diminish her rights in any way.”
