Hadith on Mut’ah: Ali corrects a fatwa of Ibn Abbas

Al-Hasan reported: Ali, may Allah be pleased with him, heard Ibn Abbas being lenient with temporary marriage to women. Ali said, “Do not be hasty, Ibn Abbas! For the Messenger of Allah, peace and blessings be upon him, prohibited it on the day of Khaybar!”

Grade: Sahih (authentic) according to Muslim

Al-Qadi ‘Iyad commented, “The consensus upon its unlawfulness solidified among all the scholars after that, except for the Rawafid. Ibn Abbas gave permission for it, but it has been narrated from him that he retracted it. They agreed that when a temporary marriage occurs now, it is ruled as invalid whether before or after consummation.”

قَالَ الْقَاضِي عِيَاضٌ وَوَقَعَ الْإِجْمَاعُ بَعْدَ ذَلِكَ عَلَى تَحْرِيمِهَا مِنْ جَمِيعِ الْعُلَمَاءِ إِلَّا الرَّوَافِضَ وَكَانَ بن عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُ يَقُولُ بِإِبَاحَتِهَا وَرُوِيَ عَنْهُ أَنَّهُ رَجَعَ عَنْهُ وَأَجْمَعُوا عَلَى أَنَّهُ مَتَى وَقَعَ نِكَاحُ الْمُتْعَةِ الْآنَ حُكِمَ بِبُطْلَانِهِ سَوَاءٌ كَانَ قَبْلَ الدُّخُولِ أَوْ بَعْدَهُ
