OIC Resolution on Female Genital Mutilation (FGM)

The following is a translation of the Organization of Islamic Cooperation’s resolution on female circumcision and genital mutilation.

In the Name of Allah, the Gracious, the Merciful

All praise is due to Allah, Lord of the worlds, and may peace and blessings be upon our Master, Muhammad, the Seal of the Prophets, and upon his family and companions.

Resolution No. 220 (23/4)

Concerning Female Circumcision in Islamic Jurisprudence

The Council of the International Islamic Fiqh Academy, an organ of the Organization of Islamic Cooperation, convened in its twenty-third session in al-Madinah al-Munawwarah from 19–23 Ṣafar 1440 AH (October 28th–November 1st, 2018 CE),

Having examined the research papers submitted to the Academy on the topic of female circumcision in Islamic jurisprudence, and having listened to the extensive discussions held on the subject,

Resolved the following:

  1. Female circumcision refers to removing a small portion of the skin (the prepuce) that covers the clitoris, while leaving the clitoris itself intact. This procedure is called removal of the clitoral prepuce or reduction of the clitoral hood.
  2. This form of circumcision is an ancient social custom that the Prophet ﷺ directed toward refinement in a manner that protects the female from exceeding customary limits.
  3. The type of circumcision described in paragraph 1 is a matter of scholarly disagreement and is not practiced in most Muslim countries. A number of jurists permitted it within strict conditions, including that it be performed under medical supervision.
  4. It is impermissible to remove or harm any part of the female reproductive organs in ways that cause injury to women or affect their marital life. Islamic Law prohibits such acts, and the perpetrator is religiously liable. The Academy supports measures taken by Muslim governments to eliminate such violations.
  5. The form of female circumcision described here does not fall under what international health organizations—particularly the World Health Organization—refer to as ‘female genital mutilation’ or cutting, which are condemned and prohibited.

Recommendation

The Academy calls upon the World Health Organization to revisit the issue of female genital mutilation by engaging religious, community, and medical leaders, in order to improve understanding of its ruling, update religious information, and to involve contemporary medical practitioners in hospitals when there is a need for circumcision. The aim is to clarify the difference between this limited form and the other types that are unanimously criminalized.

بشأن خفاض الإناث في الفقه الإسلامي

إن مجلس مجمع الفقه الإسلامي الدولي المنبثق عن منظمة التعاون الإسلامي، المنعقد في دورته الثالثة والعشرين بالمدينة المنورة، خلال الفترة من: 19-23 صفر 1440هـ، الموافق: 28 أكتوبر- ا نوفمبر 2018م

وبعد اطلاعه على البحوث المقدمة إلى المجمع بخصوص موضوع خفاض الإناث في الفقه الإسلامي وبعد استماعه إلى المناقشات الموسعة التي دارت حوله

قرر ما يلي

خفاض الإناث يقصد به قطع قدر يسير من الجلدة المستعلية فوق البظر مع ترك البظر نفسه سليمًا وهذه العمليَّة تسمى عملية خفاض غطاء البظر أو عمليَّة تخفيض قُلفة البظر

إن هذا الخفاض يعتبر عادة اجتماعية قديمة وجه الرسول صلى الله عليه وسلم إلى تهذيبها على الشكل الذي يحمي الأنثى من تجاوز الحد المعتاد

خفاض الإناث المشار إليه في الفقرة (١) محل خلاف بين أهل العلم ولا يمارس في أكثر بلدان العالم الإسلامي وقد أباحه عدد من الفقهاء ضمن الضوابط والشروط التي ينبغي أن تتوفر عند إجرائه ومنها أن يكون تحت إشراف طبي

لا يجوز المساس بأي جزء من أجزاء الجهاز التناسلي الأنثوي؛ لما فيه من الإضرار بالإناث وحياتهن الزوجية وهذا الفعل تحرمه الشريعة الإسلامية ويُجرّم فاعله شرعًا ويؤيد المجمع الإجراءات المتخذة من قبل حكومات الدول الإسلامية للقضاء على هذه التجاوزات

لا يدخل خفاض الإناث المقرر هنا ضمن مصطلح تشويه الأعضاء التناسلية الأنثوية أو قطعها المنصوص على منعها والتحذير منها لدى المنظمات الصحية الدولية وخصوصا منظمة الصحة العالمية

توصية

يطالب مجلسُ المجمع منظمةَ الصحة العالمية بإعادة طرح موضوع تشويه الأعضاء التناسلية للإناث للدراسة بإشراك القيادات الدينية والمجتمعية والطبية لتحسين فهمها ومعرفة حكمها وتحديث معلوماتها الدينية والاستعانة بالممارسين الطبيين المعاصرين في المستشفيات؛ عند حاجة النساء إلى الخفاض، وتوضيح الفرق بينه وبين غيره من الأنواع المتفق على تجريمها
